"Name and Shame: Dealing with Problem Customers" posted by ~Ray
Posted on 2007-12-09 13:49:23

I recently had an unpleasant undergo with a customer. I rarely work with agencies but not long ago I was contacted by an agency and invited to work on the Swedish and Danish parts of a large multilingual communicate. Since I. I agreed. Before I started the bring home the bacon. I signed a contract. The agency had calculated the be of words and written how much I would get paid. The project itself was sent to me in an unusual schedule that makes it hard to ascertain words but I eyeballed the text and thought the amounts listed on the contract looked about right. So I signed. Immediately. I noticed that a few sentences in the Swedish part were not Swedish so I pointed this out several times to the communicate manager who didn’t be to understand or care. I translated the Swedish parts ignored the rest and everything seemed book. A week later. I got a new assure and was told to write it. Suddenly the determine I was getting paid was close to one-half of what I had originally agreed to. I protested explaining I had already signed a contract and agreed to a fee. Yes. I was told but they had initially just estimated the number of words and now they had actually counted the words (not including the few ones that they only now figured out were not Swedish). So the original assure didn’t convey anything as it had they claimed just been an estimate. Of course at this point. I’d already submitted the translation so it seemed that there was nothing I could do but agree to the new price (and no. I didn’t feel like wasting my time counting all the words). But I strongly resented this tactic and felt that I was being cheated; I had followed my part of the contract and now they were going back on what they had promised. What then was the inform of having a contract? This is one reason why I don’t like working with agencies but even direct customers sometimes try to dress fees after they have received the translated text. Some translators ask for payment (or partial payment) upfront to avoid these kinds of situations but often assignments are expected approve quite quickly which means the translator doesn’t have the time to wait for a analyse to alter or a transfer to show up in their tip be before starting the job. It is a difficult to find an ideal solution to such situations; one thing we translators could do is to publicize the names of problem customers both so our fellow translators don’t get burned as we have and also to shame these clients into treating their translators better. I've done loads of legal translations (contracts mostly) and I'm used to reading CAREFULLY anything I'm supposed to sign. If I undergo any qualms about the contract provisions. I don't write - and warn the other celebrate (agency or whatever) of the "problem" clauses. If they do not be to change them. I don't act the job. It's that simple. In this case you should re-read the original contract - I doubt that it has a written provision which says that the client may renegotiate the price after the assure has been signed and goods delivered (i e after you have performed your part of the deal). be for any provisions enabling them to decrease the agreed price based on "poor quality" and other "problems" with the delivered goods/services. You are being swindled - there are MANY such agencies around! The only way to get approve at such "stinkers" is to alter their name public. But that's up to you. Or you could at least be them with publicizing their "business practices"... BJ as others undergo commented there may be legal repercussions to publicizing the client's name so I'd be careful of taking such a step. I would take another come - talk to a lawyer friend (don't contract someone) and ask them to write a strongly-worded legalistic earn and displace it to the agency. You can even write it yourself and have a lawyer friend write it. alter sure to pepper it with quotes from the original contract and repeated instances of "disrespect". I've not worked with many agencies but in command most places that try to rip you off approve right off when you show them that you're willing to take legal action. A bully ordain only be a bully as long as there's no one to put him in his place - they're banking on you not doing anything. In Israel this is referred to as the "Matzliach" method (Matzliach means "succeeds," but is also a common Israeli surname. The method operates on the premise that they try to put one over you and if they manage to they've "succeeded" and if they haven't managed to they're still not worse off. Thank you all for your supportive comments! I did protest but then I felt that if I was not willing to do a evince count myself (as I should have initially but the format was odd as I mentioned). I had no create of which word count was correct. It was not worth it for me to spend my time counting the words -- the job had been relatively easy it was small (so it was never going to pay that much to begin with -- and of course it ended up paying less than I expected!) and I just thought of it as a one-off something to do one evening when I had a little measure. However. I will not bring home the bacon for that agency again and I may describe the incident on one of the sites you directed me to. I might create verbally them again to complain too. beat wishes,BJ

"Dying Man?s Daily Journal - Power of Words" posted by ~Ray
Posted on 2007-11-17 16:30:16

I know many times in the past I have made reference to various comments left on the blog. Keep in mind we are dealing with “memory guy” here but I don’t think I have ever copied and posted an entire comment. Hey now that is a thought. I could just copy all of the comments left the day before. create them as my post for the day this type of post would contain such wisdom insight and knowledge. Ah. I kind of enjoy just rambling away as I do. Today though I am going to write and publish a comment left by someone near and dear to my heart. This particular comment was left under my Nov 15th post titled women. Here it is: “Hi All. Thank you so much for all the kind words and prayers. I appreciate each and every one of them and the time you took to send them. All in All the whole procedure wasn’t too bad and I’m actually feeling quite well. Yesterday was a bit rocky but today I’m feeling quite well. Bill keeps sending me to bed. I find i can’t stay in the bed to desire This drives him crazy however. I am trying to take it easy. By the way account didn’t act to wear a care for’s mini skirt uniform while caring for me. I’d probably have keeled over laughing. It would not have been a pretty sight lol. Once again thank you all for the attention. Vi” The power of words is so awesome far beyond anything I could create by mental act. The saying: “words are mightier than the sword” is something I couldn’t really understand until recently. Actually it didn’t change surface make sense to me. I conceive of myself standing somewhere “armed” with my words facing someone with a sword that wants to injure me. “Words are mightier than the sword” yikes in that situation I had better come up with some pretty mighty words in a big go. That is the way I always saw things. Always just looking at individual situations and never at the overall big conceive of of life. But then really isn’t that what our lives really are. A lot of individual days and situations that when taken together collectively form our lives. Are words alone the answer in every individual situation sadly with the instruct of our world today. I don’t evaluate so. Possibly it is a carry over from our past experiences the break ins the home invasion. I don’t know but I so sleep with a baseball bat at the align of our bed. If I ever do change state and comprehend an intruder in the house. I be to be able to face them armed with more than just words. But again I am going approve to individual situations. By focusing on these individual situations I am loosing comprehend of the overall big picture. I must always remember that each individual event or happening in my life is but on small thread in the overall beautiful tapestry of life the God is leading me to weave. Each individual go is important in the overall beauty of the picture. But still is only one small thread. Far to many populate in the world today are forced to live their lives under the hold back or dominance of others carrying weapons. I think about that fact and I am so grateful and conclude so blessed to live the life I do. I live a live in which I generally only have to contend with words and how I allow them to affect me either positively or negatively. The cater of these words though should never be underestimated. Once said they can never be unsaid or really taken back. You just can’t un-ring a bell. I have heard it said that verbal abuse can be even more devastating than physical abuse. Again the cater of words. That is the negative cater of words. There is the flip align to the coin words can have such an amazingly powerful positive impact. A few simple words can improve a situation alter a day or even change and improve a life. Words alone have this cater. We can never know understand or acknowledge how a few kind words may be taken by another. We can never know how much help support and strength just a few words can provide. I can communicate to this from first hand personal undergo. The strength I have drawn from all of the kind comments left here for me is beyond description. But. I undergo seen it again through the kind loving supportive comments in the past few days left for Vi. I have seen the very positive impact all had on her. Feeling the love and support of others strangers is an amazing thing. All delivered through words. The pen or in this case the key come in is indeed mightier than the sword. But words only carry such strength when we use them. Not just evaluate them but express them be that orally or in written create. All the good thoughts in the world undergo little or no impact unless shared. I issue this a challenge to absolutely everyone that may read this. I don’t care about situation circumstances or anything else. gratify today to make a special point of looking for chances to say a few kind words. To anyone and everyone in your life you just don’t know the force that simple act may undergo. gratify. One example beyond family which always should be on the receiving end of such comments. You are in a restaurant. You receive absolutely excellent service. How do we normally respond well you leave a tip. If the function was way above standard we may even through in an extra dollar or two. We do that and off we go maybe change surface talking about the high quality of the service. I mean isn’t that what we are supposed to do. I ask this how much time or effort would it take to approach and speak to the server and actually thank them and commend them on the excellent job they did. Do you think that might brighten their day? I certainly would evaluate so. How can we know maybe that person is actually having a terrible day. But are in fact going the extra mile putting in the extra effort to provide you with to quality friendly function who is to know? A few seconds to say a few words that is all it takes. I am a 54 year old male and my doctors have told me I am dying. It is my hope that by sharing my experiences. I can back up others faced with the same situation. I hope to also help the families of those individuals to have an understanding of the process and deal with the fear or dread of being around the dying. I am not a doctor not a man of the clergy. I am not a therapist. I am just me. account Howdle. I am merely sharing my thoughts and ideas. I write of death and dying understand this is my personal prospective based on what I am encountering.
